Chapter 1 General Provisions
Article 1: In order to effectively strengthen the management of special construction workers, improve their safety awareness and basic skills, and prevent and reduce accidents, these measures are formulated in accordance with the State Council's Regulations on Safety Production Licenses, the Ministry of Housing and Urban Rural Development's Regulations on Safety Supervision and Management of Construction Hoisting Machinery, and the Regulations on Management of Special Construction Workers.
Article 2: This method applies to the assessment of special construction workers in our province and the supervision and management of special operation workers. The special operation personnel referred to in these measures refer to those who engage in construction activities of housing construction and municipal infrastructure projects that may cause harm to the safety of themselves, others, and surrounding equipment and facilities.
Article 3: Special construction workers shall pass the assessment of the construction administrative department and obtain the "Operation Qualification Certificate for Special Construction Workers" (hereinafter referred to as the "Qualification Certificate") before taking up the corresponding job.
Article 4: The Department of Housing and Urban Rural Development of Zhejiang Province is responsible for the examination, assessment, and supervision and management of special construction personnel throughout the province. Entrust the construction administrative departments of various districts and cities (including Yiwu City, the same below) to be responsible for the assessment of safety operation skills and the issuance of qualification certificates for special construction workers in the local area. The construction administrative department at or above the county level shall supervise and manage special construction workers.
Article 5: The construction administrative departments of each district or city shall, in accordance with the requirements of unified deployment, requirements, and standards, implement the necessary venues, equipment, personnel, funds, etc. for conducting assessment work. For those who do not meet the requirements for conducting assessment or whose quality of assessment and certification work does not meet the requirements, the safety operation skills assessment and qualification certificate issuance work of special construction workers may be suspended.
Article 6: Construction enterprises, relevant industry associations, and social construction training institutions shall strengthen the education and training of special construction workers, provide continuing education for certified personnel, and promote the continuous improvement of safety awareness and operation skills of special construction workers.
Chapter 2 Assessment
Article 7: Special construction workers include: (1) construction electricians; （2） Construction welders (including welders and cutters); （3） Construction general scaffolding workers; （4） Construction attachment lifting scaffolding scaffolding workers; （5） Construction crane signal rigger (including commander); （6） Construction tower crane driver; （7） Construction elevator driver; （8） Construction material elevator driver; （9） Installation and dismantling workers for building tower cranes; （10） Construction elevator installation and dismantling worker; （11） Construction material elevator installation and dismantling worker; （12） High altitude work basket installation and dismantling worker.
Article 8: The assessment content for special construction personnel includes safety technology theory exams and actual safety operation skills assessments. The assessment outline and question bank are formulated by the Provincial Department of Housing and Urban Rural Development.
Article 9: The safety technology theory exam shall adopt a closed book written test method; The assessment of safety operation skills adopts a simulated operation method. The safety technology theory exam and safety operation skill assessment both implement a percentage system. Passed the safety technology theory exam with a score of 60, and passed the safety operation skills exam with a score of 70.
Article 10: The safety technology theory examination shall be subject to a provincial unified examination. The exam adopts a unified outline, unified proposition, unified paper making, and unified grading method. Those who pass the exam will be recorded in the "Zhejiang Construction Special Operations Personnel Management Information System" and announced.
Article 11: Personnel applying for the safety technology theory examination shall register with the construction administrative department of the district or city where the enterprise is located. Those who meet the requirements after examination shall uniformly fill out the summary form for the examination and assessment (extension) of special construction personnel (see Attachment 1), and report it through the "Zhejiang Province Special Construction Personnel Management Information System". Those who take modern exams or engage in other cheating behaviors are not allowed to take the exam again within one year.
Article 12: Personnel applying for safety operation skill assessment shall be responsible for the safety operation skill assessment by the construction administrative departments of each district or city. After passing the assessment and making public no objections, the construction administrative departments of each district and city shall report the qualified personnel information through the "Zhejiang Province Construction Special Operations Personnel Management Information System" before the 15th of each month.
Article 13: Personnel applying for the safety operation skill assessment of special operation personnel shall meet the following basic conditions: (1) They shall be at least 18 years old and meet the age requirements stipulated by relevant types of work; （2） Junior high school or above education; （3） Passed the physical examination at a second class and second class hospital. Require no hearing impairment or color blindness; Having a naked vision of 4.8 or above in both eyes and a corrected vision of 5.0 or above (for construction electricians and construction crane drivers, corrected vision of 5.0 or above); There is no disease hindering the work, such as heart disease, epilepsy, Meniere's disease, vertigo, hypertension, psychosis, sudden syncope, and nervous system disease affecting physical activity (physical examination form, Appendix II); （4） Other conditions that meet the requirements of corresponding special operations.
Article 14: Personnel applying for the safety operation skill assessment of special operation personnel shall submit the following documents: (1) Application Form for Examination and Assessment (Extension) of Special Operation Personnel in Construction (in duplicate, see Attachment 3); （2） Original and photocopy of ID card; （3） Original and photocopy of educational certificate; （4） Certificate of passing the physical examination within the past three months; （5） Other materials deemed necessary by the assessment authority.
Article 15: Personnel who pass both the safety technology theory examination and the safety operation skill assessment may be issued qualification certificates to relevant personnel through the "Zhejiang Construction Special Operations Personnel Management Information System" after being published by the "Zhejiang Construction Special Operations Personnel Management Information System".
Chapter 3 Certificate Management
Article 16: Special construction workers shall participate in annual safety education and training or continuing education. Within one validity period, not less than 48 class hours.
Article 17: The validity period of the Qualification Certificate is two years. If the validity period needs to be extended, the certificate holder shall apply to the original issuing authority for extension procedures within 3 months before the expiration. If the issuing authority reviews and meets the extension conditions, the certificate shall be printed and stamped with the official seal of the competent department through the "Zhejiang Construction Special Operations Personnel Management Information System", and the validity period of the qualification certificate shall be extended for two years.
Article 18: When applying for the extension of certificates for special construction workers, the following documents shall be submitted: (1) Application Form for Examination and Assessment (Extension) of Special Construction Workers (Attachment 3); （2） Original and photocopy of ID card; （3） Medical examination qualification certificate (requirements are the same as Article 13); （4） Annual education and training or continuing education certificate.
Article 19: During the validity period of the qualification certificate, if any of the following circumstances occur, the delayed review result shall be deemed unqualified and the certificate shall be cancelled. （1） Exceeding the statutory retirement age for relevant types of work; （2） Failure to provide a physical examination certificate or physical condition no longer suitable for special job positions; （3） Failure to participate in annual safety education and training or continuing education as required; （4） Having two or more records of illegal operations within a valid period; （5） Those who bear certain responsibilities for production safety accidents. If the delayed review does not meet the requirements and the certificate needs to be cancelled, the construction administrative departments of each district or city shall cancel it through the operation of the "Zhejiang Province Construction Special Operations Personnel Management Information System".
Article 20: Certificates that have exceeded their validity period shall not be used. If the validity period is exceeded and the certificate extension is not applied for, it shall be deemed that the certificate holder voluntarily gives up and the certificate shall be automatically cancelled.
Article 21: The following similar types of work and the same person can apply simultaneously: (1) construction ordinary scaffolding scaffolding scaffolding worker and construction attached lifting scaffolding scaffolding scaffolding worker; （2） Construction tower crane driver, construction elevator driver, and construction material elevator driver; （3） Installation and dismantling workers for building tower cranes, installation and dismantling workers for building construction elevators, and installation and dismantling workers for building material elevators.
Article 22 The name, ID number, operation type and other information on the certificate shall not be changed. If the certificate holder needs to apply for certificate cancellation, he/she should bring the original (copy) of his/her ID card to the relevant assessment authority to handle the cancellation procedures, and submit a voluntary application cancellation report signed by him/her, with a fingerprint attached.
Article 23: If the "Qualification Certificate" is lost, it shall be declared invalid in a newspaper at or above the district level where the original issuing authority is located within one month. The applicant shall bring the original and photocopy of the ID card to the original issuing authority to apply for a replacement certificate. The authority responsible for handling lost and replacement certificates shall input the lost and replacement certificate information into the "Zhejiang Construction Special Operations Personnel Management Information System" and issue a replacement certificate. The original certificate number will be invalidated after the certificate is supplemented.
Article 24: No unit or individual shall illegally alter, resell, lease, lend or transfer the Qualification Certificate in any other form. No unit or individual may seize a certificate for any reason.
Chapter 4 Employment
Article 25: The "Qualification Certificate" does not specify the unit where the holder belongs, but the holder shall be employed by a construction enterprise or construction machinery rental unit (hereinafter referred to as the "employer") before engaging in corresponding special operations.
Article 26: Special construction workers shall strictly follow technical standards, specifications, and procedures, correctly wear and use safety labor protection equipment, and maintain and inspect the work tools and equipment according to regulations.
Article 27: Special operation personnel have the right to refuse operations when their safety protection facilities do not meet relevant requirements, and have the right to request relevant units to provide a safe and reliable working environment. When an emergency situation endangers personal safety occurs during construction, special construction workers have the right to immediately stop the operation or evacuate the hazardous area, and report to the full-time safety production management personnel on the construction site.
Article 28 Employers shall fulfill the following responsibilities: (1) Sign labor contracts with special operation personnel holding valid qualification certificates; （2） Develop and implement safety operation procedures and relevant safety management systems for special operations personnel in the unit; （3） Based on the actual situation of the construction site, provide written safety technical disclosure to special operators, and inform them of the hazards of illegal operations; （4） Provide complete and qualified safety labor protection equipment and conditions for safe operation to special operation personnel; （5） Organize special operation personnel to participate in annual safety education and training or continue education according to regulations; （6） Establish a management file for special operation personnel in the unit; （7） Investigate and record violations by special operation personnel; （8） Other responsibilities clearly defined by laws, regulations and relevant regulations.
Article 29: Employers shall arrange for at least 3 months of internship for personnel who have obtained their qualification certificates for the first time before their official start of work. Article 30: For construction enterprises outside the province engaged in construction activities in our province, their special operators shall hold a "Qualification Certificate" issued by the construction administrative departments at all levels in the province (district, city) where the enterprise is located. However, special operations personnel holding a qualification certificate outside the province are not allowed to engage in special operations within the province under the name of an enterprise within the province.
Chapter 5 Supervision and Management
Article 31 The competent construction administrative department of the people's government at or above the county level shall strengthen the informatization management of the certificated personnel and the on-site certificated personnel, and strengthen the supervision and inspection of the employment of special operation personnel with certificates. During the inspection, the original copies of the "Qualification Certificate" and "ID Card" must be used as the basis, achieving the integration of personnel and certificates. If necessary, certificate information can be queried through the Zhejiang Provincial Construction Information Port. If the original copies of the Qualification Certificate and ID Card are not submitted, or if the person and ID card are inconsistent or the information after inquiry is inconsistent, they shall not be recognized.
Article 32: The construction administrative department of the people's government at or above the county level shall strengthen the supervision and management of special operation personnel and employers. If any violations of relevant national laws and regulations are found, they shall be dealt with in accordance with the law.
Article 33: In the process of supervision and inspection, the construction administrative department of the people's government at or above the county level shall order special operators to make corrections if they find that they violate regulations or their work results do not comply with relevant national standards and specifications. At the same time, the violation records shall be recorded in the "Zhejiang Province Construction Special Operators Management Information System".
Article 34: During the supervision and inspection process, the construction administrative department of the people's government at or above the level of a district or city may temporarily withhold the certificate of special operation personnel if they discover the following situations. The temporary detention period is from 30 to 90 days. At the same time, record the temporary detention information into the "Zhejiang Province Construction Special Operations Personnel Management Information System" and inform the parties of the temporary detention decision. （1） Engaging in special operations in units without signing labor contracts; （2） Improper use of safety labor protection equipment; （3） Unauthorized illegal operations; （4） Disobeying the management of the unit, project general contracting unit, supervision unit, and government supervisory personnel at all levels; （5） Failure to fulfill the obligation of rectification seriously in response to the rectification requirements proposed by the inspectors; （6） Having other illegal and irregular behaviors. If the party involved continues to engage in special operations without authorization during the certificate suspension period, the suspension period will be increased by 30 to 60 days. During the supervision and inspection process, the construction administrative department of the county-level people's government shall propose temporary detention suggestions and relevant evidence materials for special operation personnel who violate the above regulations and need to temporarily withhold their certificates, and submit them to the construction administrative department of the divided city for temporary detention processing.
Article 35: During the supervision and inspection process, if the construction administrative department at or above the level of a district or city discovers the following situations of special operation personnel, the administrative license for them shall be revoked, the certificate shall be revoked, and the certificate information shall be cancelled through the "Zhejiang Province Construction Special Operation Personnel Management Information System". （1） The certificate holder fraudulently obtains the qualification certificate or applies for extension procedures; （2） Without the consent of the individual, the unit to which they belong applies for a certificate without authorization; （3） Lending certificates to others and allowing them to engage in special operations in their own name; （4） Refusing to listen to the advice of relevant management personnel on site and forcibly continuing illegal operations; （5） Those who engage in serious illegal operations; （6） Continuing to engage in special operations without authorization again during the increased temporary detention period; （7） Those who are responsible for causing harm or accidents to themselves or others due to illegal operations; （8） Within the administrative region of this province, the certificate has been temporarily detained twice (including) within one validity period; （9） Other situations stipulated by laws and regulations. The relevant parties whose certificates have been withdrawn and entered into the "Zhejiang Construction Special Operations Personnel Management Information System" shall not apply for the "Qualification Certificate" again within three years, except for the second item.
Article 36: If the county-level construction administrative department discovers during supervision and inspection that special operation personnel have the situation specified in Article 35 and need to have their certificates revoked, it shall request the construction administrative department of a city divided into districts to implement it and submit relevant evidence materials.
Article 37: In any of the following circumstances, the construction administrative department at or above the level of a district or city shall cancel its certificate: (1) If it is found during supervision and inspection that it does not meet the requirements for assessment and certificate issuance; （2） Those who are subject to certificate revocation processing; （3） I voluntarily apply for cancellation; （4） Those who have exceeded the validity period of the certificate by 3 months and have not applied for a certificate extension; （5） The certificate holder is unable to continue engaging in special operations due to health or other reasons; （6） The certificate holder dies or no longer has full civil capacity; （7） The issuing authority believes that it should be cancelled.
